Information Officer

The right to access information possessed by, managed or overseen by the Office for Cooperation with NGOs is regulated by the Law on Right to Access Information (Official Gazette 25/13, 85/15, 69/22).

The Law on Right to Access Information (Official Gazette 25/13, 85/15 and 69/22) shall regulate the right to access information and re-use information owning by the public authorities. It prescribes principles of the right to access and re-use of information, right to access and re-use of information limitations, the procedure for exercising and protecting the right to access and re-use of information. It also prescribes the scope, mode of operation and conditions for the appointment and dismissal of the Information Commissioner, the inspection supervision of the implementation of this Law, the infringing provisions related to the exercise of the right of access to information and other obligations of public authorities.

The aim of the Law is to enable and ensure the exercise of the right to access information, as well as the re-use of information by natural and legal persons, guaranteed by the Constitution of the Republic of Croatia, through the openness and publicity of the activities of public authorities.

The right to Access to Information is based on the principles of openness and free access, timeliness, completeness and accuracy of information, the principle of equality the access to information. Also, according to the point 5 of the paragraph 1, Article 5 of the Law, the right to Access to Information, “comprehends the beneficiary’s right to seek and obtain information, as well as the obligation of the public authority body to provide access to the requested information, that is, to publish information regardless of the appointment set when such publication stems from the obligation determined by the law of other regulation”.

The information, in terms of the said Law (the point 3 of the paragraph 1 of the 5th Article), represents “every data that public authority body has in the form of documents, records, files, registers, regardless of the way it is shown (written, drawn, printed, recorded, magnetic, electronic or other record), which made the body only either in collaboration with other bodies of received from another person, and arose within the scope of or in connection with the organisation and work of the organisation and work of the public authority and work.

The re-use of Information in accordance with the point 6 of the paragraph 1 of the 5th Article of the Law “means the use of the public authority body information by the physical or legal persons for commercial or non-commercial purpose different from the original purpose  that information were made for, which is realized under the law or other regulation of a particular scope or work that is commonly considered public.

Public body has the right to compensation for actual costs incurred by the applicant in connection with the provision of the information requested. The fee for access to information and payment of fees are prescribed by the Criteria for determining the amount of compensation of actual costs incurred and costs of delivery of information.
